Perceptive Panel Terms and Conditions

These Terms and Conditions (Terms) apply to the use of Perceptive Group Ltd services including without limitation becoming a member of the Perceptive Group Ltd panel (Panel), participating in any survey or studies offered, provided, hosted or conducted through a Perceptive Group Ltd website(s), your eligibility and/or redemption of rewards including draws and prizes offered for certain activities (Services).
By accessing and using the Services you acknowledge you have read and expressly agree to comply with and be bound by these Terms.
We reserve to right to amend these Terms at any time. Your continued use of, access to and/or participation in the Services constitutes your acceptance of these Terms as amended.
1. Member Eligibility
(a) Panel members must meet the following eligibility requirements:
(i) You are 16 years or older, or
You are between the ages of 14 years and 15 years and have the informed consent of your parent or guardian to be a member of the Panel and to participate in surveys and prize draws.
(ii) In the case of the New Zealand Panel, you are a resident of New Zealand, or
In the case of the Australian Panel, you are a resident of Australia.
By accepting these Terms you acknowledge and agree that:
(a) You meet the Panel member eligibility criteria above.
(b) You will not register as a Panel member more than once.
(c) You will not attempt to answer a survey more than once, either by using more than one name or more than one email address to enter any survey.
(d) Each survey has been answered personally and the responses are honest and there are no inaccurate, false or meaningless information provided.
(e) The Services are for personal and not commercial use and you are not a representative or otherwise connected to a competitor of Perceptive Group Ltd or joined the Panel for the sole purpose of understanding our activity for competitive advantage.
(f) You have provided accurate and current personal information for you and your parent or guardian (if required) and agree to update this information when necessary and at least every 6 months to ensure that it is current at all times. You may update your personal profile by accessing your Panel membership account or sending an email to [email protected].
(g) Surveys will often include confidential information that is the property of our research client. You must keep all information including, but not limited to, new product ideas or concepts, advertisements and any other intellectual property, confidential and must not disclose this information or material to any other person including friends, family or any other organisation. You will not in any way copy, download or take screen shots of any information shown in a survey.
(h) You agree not to engage in any fraudulent activity, including but not limited to speeding through surveys, taking the same survey more than once, masking or forging your identity, submitting false information during the registration process to become a Panel member, submitting false or untrue survey data, redeeming or attempting to redeem rewards through false or fraudulent means and/or tampering with our survey in any way.
(i) You may not transfer, assign or pledge points or rewards to any other person or party. You have no property rights or other legal interest in any points granted in connection with Perceptive Group Ltd reward programme.
(j) Points have no cash value – they can be redeemed for vouchers and/or PayPal cash.
(k) You accept that you may receive surveys and research requests from third parties who use our panel.
4. Prize Draws
(a) Chances to win prizes are offered to every Panel member invited to participate in certain surveys and correctly completes that survey by the closing time specified in the invitation (Prize Draw Entrant).
(b) For some surveys we will randomly select a specified number of Prize Draw Entrants who will win a prize or prize voucher. This will be detailed in any survey which is offering a prize or prize voucher.
(c) Perceptive Group Ltd reserves the right to ask you to confirm your details at the time you are contacted as a prize winner and if these details are not correct and up to date, you will forfeit any right to that prize or prize voucher.
(d) All Prize Draws will take place within four weeks of the close of the survey, month or stated prize period and the winner/(s) will be notified by email and/or telephone using the details in that member’s records.
(e) Each prize winner consents to Perceptive Group Ltd publishing his/her name on the Perceptive Group Ltd website, any marketing material or other forum Perceptive Group Ltd deems reasonably appropriate.
(f) If we are unable to contact a prize winner or the prize winner fails to respond to our email notification to claim the prize or prize voucher within four weeks, then the prize or prize voucher will automatically be forfeited and a second prize winner will be drawn. The same rules apply to any subsequent prize winners. Perceptive Group’s decision will be final and binding and no subsequent correspondence will be entered into by Panel members who fail to accept a prize within the specified timeframe.
(g) If a prize winner is under the age of 16 years their parent or guardian may be required to sign acceptance on their behalf to claim a prize or prize voucher.
(h) Perceptive Group Ltd reserves the right to alter the structure of prize draws and prizes at any time.
(i) Perceptive Group Ltd accepts no liability for any costs, expenses or liability incurred by a prize winner with respect to prizes won. Prizes will be as stated on this website or in any survey invitation and cannot be exchanged for cash.
5. Our Obligations
(a) Consider your eligibility to take part in each survey.
(b) Inform you of the amount that will be credited to your member account once we are satisfied that the survey has been correctly and completely answered.
(c) Credit the points to your membership account within 2 weeks of correct completion of the survey. For further details on how points are awarded and how to redeem rewards see our FAQs.
(a) Perceptive Group Ltd does not endorse, sponsor or assume liabilities for any of the suppliers, manufacturers or providers of rewards or for any products, services, items or gift cards or any of the practices, policies or terms and conditions of third parties.
(b) Perceptive Group Ltd will not be liable or responsible for any lost, misplaced, stolen or misused rewards and is not responsible for any points that are misused by any individual which you have allowed to use or access your account.
(c) If your points are not redeemed within 12 months of being granted, you will not be entitled to the rewards and Perceptive Group Ltd will clear your member account which will be reset to zero.
(d) Perceptive Group Ltd does not warrant that this website will operate uninterrupted or error/virus free or that information on this site is accurate or complete at any given time.
(e) Perceptive Group Ltd shall not be liable to you or any other person or entity in any way, whether arising under contract, tort (including negligence) or otherwise, for damages of any kind arising from the use of this website, including, but not limited to, direct, indirect, incidental, punitive or consequential damages, lost revenue or profits, lost or damaged data or other commercial or economic loss that result from the use of or inability to use this website. If this limitation of liability provision is deemed unenforceable, either in whole or in part then such parts as are unenforceable shall be deleted, the remaining parts shall remain in full force and effect and the liability of Perceptive shall be limited to the greatest extent permitted by law.
(a) Your member account may be suspended or terminated by us at any time for inactivity (i.e. you fail to take part in 6 consecutive surveys within a 12 month period), suspected fraudulent activity or breach of these Terms.
(b) Please note that in the event your account is suspended or terminated, your account balance and rewards will be automatically forfeited. If Perceptive Group Ltd determines at its sole discretion that your account was suspended or terminated in error, we may restore your account to an active status and restore any lost points/rewards. Perceptive Group’s determination in any such matter will be final and binding.
(c) You can cancel your membership at any time by unsubscribing from the Panel by selecting ‘unsubscribe’ on any survey invitation you receive or by emailing, telephoning or otherwise supplying notice to us using our contact details on this website. The termination will take place within 3 working days after receipt of your notification.
(d) You should redeem all your points available for redemption prior to closing your account. Perceptive Group Ltd will not retain information on the points and redemption history of each Panel member following termination or cancellation of your account.
8. Voluntary Participation
(a) You may choose not to participate in any survey. An “unsubscribe” choice is included in every communication to prospective market research survey respondents and those who exercise it will be added to our unsubscribed list. You may otherwise elect to unsubscribe at any time and are under no obligation to participate in our surveys.
(a) You agree to indemnify and hold harmless Perceptive Group Ltd and any affiliated or subsidiary companies and our respective members, managers, shareholders, directors, officers, employees and agents from and against any and all claims liabilities, losses, judgments, awards, fines, penalties and costs and/or expenses of any kind including without limitation reasonable lawyers’ fees and Court costs arising out of or resulting from or caused by either directly or indirectly:
(i) Your breach or violation of these Terms; and/or
(ii) Your use or participation in and/or access to our Services.
10. Governing Law
(a) This agreement between Perceptive Group Ltd and Panel members shall be governed by the laws of New Zealand. The parties submit to the non-exclusive jurisdiction of the Courts of New Zealand.
In order to use this website, users must first complete the registration form and provide some personal information including demographic information and contact information. Perceptive Group Ltd uses your demographic information (such as age, gender, etc.) to invite you to appropriate research sessions. We also use the demographic information you submit to interpret the results of our research. (For example, if we did a survey on television watching habits we might report that 60% of single people watch TV at least 3 days a week.) Perceptive Group Ltd uses your contact information (such as name, email address, and postal address) to invite you to participate in Perceptive Group Ltd sessions and to pay you for your participation. Perceptive Group Ltd will not disclose your identity or any of your personally identifiable information without your authorisation.
A cookie is a piece of data stored on the user’s hard drive containing information about the user. Perceptive Group Ltd may collect non-personal information about the computer, mobile telephone, smartphone or other device that you use to access our products or services. Where you allow our mobile services and products to deliver content based on your location (by enabling this feature on your mobile device) we may collect location data. 13. Log Files
We use IP addresses, browser type, referring URLs, operating system, and date/time stamp to analyse trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use in optimising the performance of our site and our services. IP addresses, etc. are not linked to any personally identifiable information.
The Perceptive Group website contains links to other sites. Please be aware that Perceptive Group is not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each and every web site that collects personally identifiable information. This privacy statement applies solely to information collected by this Web site.
15. Super Panel
Privacy Act 2020 Consent
You consent to and acknowledge that:
(a) Transactional data (including details of payment amount, date/time, merchant [list other information to be collected] recorded through your payment card(s) registered with Perceptive Group Ltd will be shared with Perceptive Group Ltd (the ”Transactional Data”)
(b) The Transactional Data together with your Personal Information will be collected, held, used and disclosed for or in connection to better understand consumer spending behaviour by Perceptive Group Ltd, Paymark Limited (”Paymark”) and its merchant customers.
(c) Perceptive Group Ltd may share the Transactional Data and aggregated data (non-identifiable personal data) with Paymark and third parties including its merchant customers.
(d) Perceptive Group Ltd will use a unique identifier to my Transactional Data and share such unique identifier with Paymark.
(e) The Transactional Data and Personal Information will be held by Perceptive Group Ltd and/or by its trusted data centres in accordance with the Privacy Act 2020.
(f) The Transactional Data and Personal Information shall be held and used for as long as Perceptive Group Ltd deems necessary for statistical and research purposes.
